There are a lot of porn sites where you can pick up a trojan is that because of the site owner or 3rd party. If it is a 3 rd party why only porn and how do they do it? How do they intercept your communication?

You must prove beyond reasonable doubt that the company is deliberately spreading viruses.

However, that is not possible. This company want to attract customers and get money. It would be crazy for them to scare away customers.

I believe that those people who put virus on porn site are some religious zealots or some jobless hackers trying to steal credit card informations.

They probably do this mostly with porn sites because they are frequented more than most websites. Usually someone hijacks your web browser and that is why you can't find answers to your problems (like the AntiVirus 2008/2009 virus) and then the virus works from there. No one would defend a person who got a virus from a porn site anyhow because society deems porn as "disgusting" and "wrong" and the company probably won't take responsibility.

No, it's the virus writer's fault. If it's a reputable company then you should let the webmaster know, if not then he probably already knows. You should always make sure that your anti-virus software is up to date (an up-to-date free AV package is much better than an out-of-date paid-for one), but there are new viruses coming out all the time so it's impossible to eliminate any risk.

it depends because if they put it on themselves you have a right to a lawsuit but if they didn't put it on it is for the police to track it down.
